This Privacy Policy applies to any information of the User when he access/visits our Sites or uses our Services and does not apply to online platforms or services that PayMate do not own or control, including platforms or services of third parties. Paymate’s privacy policy applies to use of the Platform application, desktop, PayMate platform and mobile WAP site, API, and all devices, functionalities, features, technologies and other services uniformly and its terms are made a part of these T&Cs by this reference. Additionally, by using our services, the User hereby expressly acknowledges and agree that Internet transmissions are never completely private or secure. The User understands that any message or information he sends to the Platform may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.
We may revise this Privacy Policy from time to time to reflect changes to our business, the Sites or Services, or applicable laws. The revised Privacy Policy will be effective as of the published effective date. The revised terms will be notified once the User logs in and hence you should review and read the terms and conditions and the privacy policy regularly.
Applicable Laws shall mean Information Technology Act, 2000, The Information Technology (Reasonable security practices and procedures and sensitive SPDI or information) Rules, 2011, The Digital Personal Data Protection Act, 2023 and any other applicable rules and regulations issued thereunder, including any guidelines, circulars, ordinance, order, judgment, notification, decree, bye-law, governmental restriction, or any similar form of decision of, or determination by, or any interpretation, policy or administration, having the force of law in India, whether in effect as of the date of this Policy or thereafter, as applicable to us.
PayMate shall mean PayMate India Limited (previously known as PayMate India Private Limited) and includes its affiliates and subsidiaries.
PayMate Associates shall mean such entities that provide and facilitate services with PayMate, including banks, acquirers and providers of payment gateways or such other vendors engaged by PayMate to provides its services.
PayMate Account/Services means any services and any and all related PayMate platforms, applications and services offered to you by PayMate in connection with your PayMate Account and include such services which may be offered by PayMate including but not restricted to digital payment solutions, invoice discounting, facilitating business credit and such other services as may be offered by PayMate from time to time.
Sensitive Personal Data/Information (SPDI) means personal information that can be associated with an identified or identifiable person. “SPDI” of a person means such personal information which consists of information relating to :-
Exception to SPDI: SPDI does not include any information provided by the User which is freely available or accessible in public domain.
Process means any method or manner in which we handle SPDI whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, and consultation, disclosure by transmission, disseminating or erasure or destruction of SPDI.
Sites means the PayMate platforms, mobile applications, official social media platforms, or other online properties through which PayMate offers the Services and which has posted or linked to this Privacy Policy.
"User": terms "YOU", "YOUR" and "USER" refer to you, as a User of PayMate Platform, mobile applications, official social media platforms, or other online properties through which PayMate offers the Services and which has posted or linked to this Privacy Policy.
“User’s Employees”: shall mean such authorised officers /individuals that are employed by the User in permanent or temporary employment.
“Vendor" shall mean an individual or legal entity named in the list of Vendors submitted by the User on PayMate Platform, from whom the User purchases Products or avails Services, offered by the Vendor on the Vendor’s Website or Mobile Application or through IVR System directed to the Internet Payment Gateway or through OTC using a Valid Card or Net Banking account or any other acceptable modes of Payment Mechanism, provided by PayMate.
By choosing to provide this personal information, a User expressly consents to the transfer and storage of that information on PayMate/ PayMate Associate servers.
The purpose of this Privacy Policy is to inform you, about the reasons for Our collection, usage, processing, storage, transfer and sharing of Your SPDI while using or accessing our Services.
We may ask you to provide us with your SPDI that we may use to contact or identify You. We may also collect your SPDI for improving our Services.

Paymate shall retain Personal information to fulfil our legal or regulatory obligations and to enable us to provide you seamless services. PayMate may retain Data for longer periods than required by law if it is in our legitimate business interests and not prohibited by law. If your Account is closed, we may take steps to mask Data and other information, but PayMate reserves our ability to retain and access the data for so long as required to comply with applicable laws. We will continue to collect, use, process, transfer and/ or disclose the SPDI until and unless the User withdraws its consent.
Pursuant to RBI Circular DPSS.CO.PD No.1463/02.14.003/2018-19 dated January 8, 2019 on “Tokenisation – Card transactions” and subsequent circulars CO.DPSS.POLC.No.S-469/02-14-003/2021-22 dated August 25, 2021, DPSS.CO.PD.No.1810/02.14.008/2019-20 dated March 17, 2020 (as updated from time to time) and CO.DPSS.POLC.No.S33/02-14-008/2020-2021 dated March 31, 2021 and RBI/2021-22/96 CO.DPSS.POLC.No.S-516/02-14-003/2021-22, (Circulars to be collectively referred as “Tokenisation Framework”), PayMate complies with Tokenisation Framework and the User at it’s sole discretion may initiate Tokenisation of the Credit Card and store the same digitally (i.e. Tokenised Card) in the Token Requestor Application for making payments through the Identified Device of the User only if the Credit Card is eligible for Tokenisation as per the policies of the Issuing Bank of the User’s credit card or otherwise misrepresent his identity, age or affiliation with any person or entity.
We use personal information for varied reasons: -
When a User utilizes the PayMate platform or sends emails or other data, information or communication to PayMate or any of its accredited service providers or banks, the User agrees and understands that such information and transaction related data may be communicated through a third-party payment gateway controlled by a PayMate Associate through electronic records and to the acquirer or the banks. The User expressly consents that such personal information and transaction related data and/or data related to the payer/payee shall be shared to such parties in course of the services provided by us. The User consents to receive communications via electronic records from such PayMate Associate periodically. Upon registration with PayMate, a User agrees that he shall be contacted on his mobile or e mail address for authentication of a transaction or from time to time about updating his content to provide features which PayMate believes may benefit him or for the purpose of receiving promotional messages. A User's information shall remain with PayMate and PayMate Associates. PayMate does not sell or rent your personal information to anyone. The User hereby confirms that he has no objection to aforesaid use of his information.
PayMate may in course of rendering its services share SPDI of the User with third-party service providers, banks, acquirers and payment gateways that perform services and functions at our direction and on our behalf viz including but not limited to processing of the transactions, providing customer support or User behaviour analysis, KYC check etc. PayMate also use such information to perform statistical analyses of User behaviour and characteristics in order to measure interest in and use of the User.
Your express consent to this Privacy Policy, which you may withdraw at any time followed by your submission of such information represents your agreement to that transfer.
PayMate may also share a User's personal information with any statutory or legal authority as may be required or mandated by that authority. PayMate may disclose personal information when required, such as to respond to legal requirements, enforce PayMate policies or protect anyone's rights, property, or safety. Such information will be disclosed in accordance with applicable laws and regulations in good faith. Please note that we are not required to question or contest the validity of any search warrant, subpoena or other similar governmental request that we receive. If required by law to do so or if considered necessary to do so for proper management of credit or business risk, PayMate reserves the right to disclose any and all such User information, including default in any payments or misuse of the service, to any court of competent jurisdiction, quasi-judicial authority, law enforcement agency, relevant wing of the Central Government or State Government, User's employer, credit reference agency, financial institution or any company which is an affiliate or associate or parent or subsidiary of PayMate. PayMate shall not sell or rent a User's personal information to third parties for their marketing purposes without his explicit consent. PayMate shall comply with the DND regulations as framed and applicable from time to time.
PayMate will only disclose your information in accordance with this Privacy Policy. If there is a requirement to use it for any other purpose, the consent of the User will be obtained.
Our PayMate platform has stringent security measures in place to protect the loss, misuse, and alteration of the information under our control. Whenever you change or access your account information, we offer the use of a secure server. Once your information is in our possession we adhere to strict security guidelines, protecting it against unauthorized access.

While we are dedicated to securing our systems and Services, you are responsible for securing and maintaining the privacy of your password(s) and Account/profile registration information and verifying that the SPDI we maintain about you is accurate and current. We are not responsible for protecting any SPDI that we share with a third-party based on an account connection that you have authorized.
The PayMate platform includes links to other platforms. Such platforms are governed by their respective privacy policies, which are beyond PayMate's control. Once a User leaves the PayMate/ PayMate Associate servers, use of any information provided by the User is governed by the privacy policy of the operator of the site which the User is visiting. That policy may differ from this PayMate policy. All information gathered on the PayMate platform is securely stored and access to such information is strictly limited based on need-to-know basis. In addition, details of a User's credit/ debit card number, PIN details for payment or for verification purposes, password and account information are encrypted by PayMate in accordance with the guidelines laid down by the PCI Standards. Further, PayMate does not store the CVV number of a User.
Our Service does not address anyone under the age of 13 ("Children").
We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you are aware that your child has or children have provided us with SPDI, please contact Us at support@paymate.co.in. If We become aware that We have collected SPDI from children under age 13 without verification of parental consent, We take steps to remove that information from Our servers.
Right to Review Your SPDI - You may review the SPDI provided by You and any SPDI found to be inaccurate or deficient will be corrected or amended by Us, as feasible. However, please note, that We will not be responsible for the authenticity of the SPDI provided by You.
Withdrawal of Your Consent - You may choose not to provide Your SPDI, at any time while availing the Services or otherwise, or withdraw Your consent provided to Us earlier, in writing to our email ID: support@paymate.co.in
However, in case the User chooses to not provide or later withdraws its consent, We may not be able to provide to the User some or all of the features and functionalities of Our Services. This may also affect Our ability to process Your SPDI and lead to the discontinuation of Our Services for which such SPDI was required to be used or was being used, at Our sole discretion.
Please note that these rights are limited in instances where We are legally required to retain Your SPDI to be compliant with the Applicable Laws.
You are aware that however as robust and effective as the security measures are, no security system is impenetrable. You hereby acknowledge that the User is aware of all security risks, including possible third-party interception of any of his transactions and statements of account on the internet and the content of his transactions or statements of account becoming known to third parties. The User agrees and undertakes that he shall not hold PayMate/ PayMate Associates liable therefore in any way. The use and storage of any information, including without limitation, the credit card number, PIN, password, account information, transaction activity, account balances and any other information available on the User's internet access device or computer or mobile phone is at his own risk and responsibility. The User furthermore acknowledges and accepts that PayMate may not encrypt all content or communications from and to their PayMate platform.
We provide all Users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from us on behalf of our partners, and from us in general, after setting up an account.
